Talent representation agreement

This agreement is between Fashion Casting, trading as Fashion Casting ("the Agency"), and the person named below ("the Talent"). It sets out what the Agency does, what it charges, what the Talent is asked to do, when the Talent is paid, and how either side ends the arrangement. It is written to be read once and understood.

2. What the Agency does

The Agency scouts, presents and books the Talent for Lifestyle division bookings: dinners, members clubs, luxury escapes, yacht and villa stays and milestone celebrations for private clients and venues. For every engagement the Agency will state in writing, before the Talent accepts: the client, the date and city, the call time and expected duration, the duties involved, the fee, the usage granted with its territory and term, the cancellation position, and the payment method.

The Agency does not accept an engagement on the Talent's behalf without the Talent's written acceptance of those terms. The Agency charges the Talent no joining fee, portfolio fee, administration fee or monthly fee, and will not do so during the term.

How the Talent is presented follows approval, not the commission basis. Once a booker has approved the Talent's portfolio in writing it is published on the Agency's private client board. Until then the Talent is not published; they are presented privately to individual clients over messenger, one client at a time. The Talent may request removal from the board at any time without any change to their commission.

3. Commission

Commission is calculated on the gross booking fee and is the Agency's only charge to the Talent.

Commission is deducted from the gross fee before payment. Travel, per diem, fittings and reimbursed expenses are paid to the Talent in full and are not commissionable. The percentage is fixed for the term and cannot be increased without a signed amendment.

4. Referral waiver

The Talent may reduce their own commission by introducing new talent or new clients to the Agency. An introduction qualifies once the introduced party signs with the Agency or completes a first paid booking.

The waiver applies to bookings from the date the introduction qualifies and holds for the remainder of the term. The maximum waiver is 10 percentage points. The Agency confirms each qualifying introduction in writing.

5. Fees and how the rate is set

Standard fees in the Lifestyle division run from USD 2,000 to USD 10,000 per event day, covering dinners, members clubs, luxury escapes, yacht and villa stays and milestone celebrations. Talent at the top of the market — Victoria’s Secret models, Miss World and equivalent titleholders, talent signed to a top agency, and influencers above one million followers — are quoted above that range, individually, per booking.

Every quotation is built from three factors, and no others:

Client budget The budget the client confirms for the engagement.
Talent profile Experience, credits, titles and audience reach.
City and continent The market the event runs in, and the cost of working there.

The fee is fixed at booking and cannot be revised downward after the event. Overtime beyond the agreed duration is charged pro rata and requires the Talent's agreement on the day.

6. Payment

The Talent is paid on the day of the event. There is no waiting period and no clearing window. The Agency pays on that date whether or not the client has settled its invoice; recovering payment from the client is the Agency's responsibility, not the Talent's.

The Talent chooses the payment method and records it below. The Agency pays by that method unless the Talent changes it in writing at least 48 hours before the event.

Where a booking requires travel, the Agency advances the cost of premium flights, accommodation and airport transfers before the Talent travels. The Talent is not asked to fund travel from their own money and has no expense claim to submit. Advanced travel is not deducted from the fee and is not commissionable.

Transfer charges levied by the Talent's chosen method are borne by the Talent. Taxes and social contributions are the Talent's responsibility unless the law of the booking country requires the Agency to withhold.

7. Duties, schedule and usage

Each brief names the duties the Talent is engaged to perform, the call time, the expected duration and the finish time. Duties outside that description are not owed, and overtime beyond the stated duration is agreed on the day and charged pro rata.

Where images are taken, the brief names the usage granted, the territory it covers and how long it runs. Nothing outside that grant is licensed. Any additional use — a new territory, an extension, a new medium — is a separate fee, quoted and agreed with the Talent before it runs. Silence is not consent.

If the Talent cancels inside 48 hours without a documented medical or emergency reason, no fee is payable and the Agency may recover costs already committed.

Where a client cancels a confirmed booking, the client pays a cancellation fee of USD 1,000 per booking in addition to anything owed to the Talent under the table above. That fee covers the held date and the work already done, and is never taken from the Talent's fee.

11. Term and termination

This agreement runs for twelve months from the start date and continues month to month afterwards. Either side may end it on 30 days' written notice. Bookings already confirmed at the date of notice are honoured on these terms, including payment and commission.

Either side may end it immediately for a material breach that is not corrected within 14 days of written notice. On termination the Agency stops presenting the Talent and removes the profile from the board within 7 days.

12. Images and data

The Talent grants the Agency the right to show their portfolio images and profile to prospective clients for casting purposes during the term. Where the Talent's portfolio has been approved, that right includes publication on the Agency's private client board; until then it does not, and images are shared only in private client correspondence. That right ends on termination, and published images are removed within 7 days. The Agency does not license, sell or publish the Talent's images for any other purpose without a separate written fee and consent.

13. Governing law

This agreement is governed by the law of ____________________ and the courts of ____________________ have exclusive jurisdiction. The parties will attempt to resolve any dispute in good faith before starting proceedings.

14. Signatures

By signing, both parties confirm they have read this agreement and accept it in full. The Talent confirms they are 18 or over, and 21 or over where the booking country or the venue requires it.

The Agency checks age against photographic identity documents before the first booking and declines any engagement whose local law the Talent's age would breach.
